Under Section 49 of the Planning and Environment Act 1987 the responsible authority must keep a register containing the prescribed information of:

  • all applications for permits; and
  • all decisions and determinations relating to permits.

The Planning and Environment Act also requires the responsible authority to make the register available during office hours for any person to inspect free of charge.

The documentation placed in the Minister's Planning Permit Application Register Online is made available for the sole purpose of enabling its consideration and review as part of a planning process under the Planning and Environment Act . The document must not be used for any other purpose, including any purpose which may breach any copyright.

In addition to the Planning and Environment Act, the Department of Environment, Land, Water and Planning and the Minister as responsible authority must comply with the requirements of the Information Privacy Act 2000, which applies, to personal information held on the responsible authority's public register.

Consequently, a condition of use of the Minister's Planning Permit Application Register Online is that you will not use the personal information in any manner other than for the sole purpose of engaging in the planning process. This includes any use that may be an interference with the privacy of an individual, such as facilitating direct marketing to a property where an entry for that property does not show consent to receive direct marketing at that address.
