The Minister for Planning is considering whether to prepare, adopt and approve Amendment C233gdan to the Greater Dandenong Planning Scheme. This includes whether or not to exempt himself from any of the normal exhibition and notice requirements of sections 17, 18 and 19 of the Act and the Regulations, as well as whether to grant Planning Permit PLN21/0713.

To inform the Minister’s decisions on these matters, consultation is being undertaken under section 20(5) of the Act about the draft amendment and the draft permit.

The draft amendment and draft permit apply to land at 51A Douglas Street, Noble Park.

What the draft amendment proposes

The amendment proposes to amend the planning provisions for the subject site at 51A Douglas Street, Noble Park by rezoning the site from Transport Zone 1 – State Transport Infrastructure (formerly Public Use Zone 4 – Transport) to Commercial 1 Zone to reflect that the land is no longer required for transport purposes.

What the draft permit proposes

The planning permit proposes to allow the development of the land for a mixed-use building, creation of a lot and easement; reduction in parking provision; and removal of native vegetation.

Specifically, the project consists of:

  • A plan of subdivision including consolidation and realignment of existing lots and creation of a new lot to excise the subject site from the railway corridor.
  • Creation of a light and air easement
  • Construction of a six-storey building with commercial and car parking on the ground floor and residential above.
  • Reduction in parking provision.
  • The removal of three trees on the site.


Before deciding whether to proceed with the proposed amendment and permit, the Minister for Planning is undertaking consultation under section 20(5) of the Act to understand the views of affected parties and to inform the drafting of both the amendment and permit.

Following the consultation period, the Minister may decide to refer this matter to the Victorian Transport Projects Integrated Development Opportunities Standing Advisory Committee for advice and recommendations before deciding whether to prepare, adopt and approve the amendment and grant the permit.

Flametree Property Pty Ltd has requested the Minister’s intervention to prepare a planning scheme amendment and grant a permit for development.

The Government Land Planning Service has recommended that the Minister consider the application and undertake consultation prior to making a decision. The Minister has not yet decided whether to prepare, adopt and approve the amendment or grant the permit.

The Victorian Government is committed to the Level Crossing Removal Project, and part of that includes identification of development opportunities on surplus land created by the completion of level crossing removals. The Government Land Planning Service was established in 2015 to facilitate changes to planning provisions for surplus government land to enable efficient reuse of land no longer required for public purposes.
