Overview
The Minister for Planning has received a request from ARA Australia Pty Ltd (ARA) to prepare, adopt and Amendment C390 to the Melbourne Planning Scheme by exercising his powers under section 20(4) of the Planning and Environment Act 1987 (the Act).
You have been identified as the owner or occupier of a property that benefits from one or more easements that are proposed to be varied by Amendment C390. Therefore, prior to making a decision on the request, the Minister for Planning is undertaking consultation under section 20(5) of the Act.
Please note that consultation is limited to the proposed variation to easements, and not the proposed redevelopment more broadly.
Background
The amendment seeks to facilitate the redevelopment of the existing retail component of 3 Southgate Avenue, Southbank (Southgate). The redevelopment would deliver new podium level retail food and beverage tenancies, a 26-level commercial office building, a 2,000 square metre public open space, pedestrian links to the Melbourne Arts Precinct, and upgrades along City Road.
The amendment would allow the land to be developed in accordance with the incorporated document, Southgate Redevelopment Project – 3 Southgate Avenue, Southbank 3006 – May 2020.
Easements
ARA owns the land and buildings identified as Lot 2 on Plan of Subdivision 328901G. The title is burdened by a number of registered easements which benefit the owners of the Langham Hotel, St John’s Church and Quay West Apartments. The redevelopment of Southgate will require a variation to some of these easements. ARA proposes to relocate or otherwise alter the location and size of the easements to facilitate the redevelopment.
