Background

In August 2008, following the consideration of the Panel Report for the proposed Hawkesdale and Ryan Corner Wind Farms, the then Minister for Planning issued Planning Permit Planning permit 2006/0221 for the use and development of a wind energy facility (Hawkesdale) and Planning Permit 2006/0222 for the use and development of a wind energy facility (Ryan Corner).  Concurrent with the Hawkesdale application, Planning Permit PL06/319 was issued by the Minister for native vegetation to be removed, lopped or destroyed. Concurrent with the Ryan Corner application, Planning Permit PL07/067 was issued by the Minister for native vegetation to be removed, lopped or destroyed.  

In June 2017, public notice of an application by United Power Generation Pty Ltd to the Minister for Planning to amend Permit Applications 2006/0221 and 2006/0222 to the Hawkesdale and Ryan Corner Wind Energy Farms respectively was given. At the time of referral to the Panel, 6 submissions were received in relation to Hawkesdale, and 11 submissions were received in relation to Ryan Corner.

In June 2017, the Minister appointed a Panel to consider the application to amend the Permits and the submissions received in response to it.

The Application is to amend Planning Permit 2006/0221 (Hawkesdale) to:

  • Correct address and title details of the land
  • Reduce the number of turbines from 31 to 26
  • Increase the maximum allowable height from 121.5 metres to 180 metres
  • Remove restriction on the maximum tower height and blade length, replacing with a restriction on the lowest swept height of:
  • metres above ground level for the 180 metre turbines
  • metres above ground level for the 160 metre turbines
  • Changes to noise conditions to require compliance with newer standards
  • Increase the distance from the nearest turbines within which a program of voluntary landscape mitigation works are available from 1.5 to 4 kilometres
  • Increase the distance from the nearest turbines within which a program of voluntary landscape mitigation works are available from 1.5 to 4 kilometres
  • Change shadow flicker requirements if consent is obtained from those affected
  • Remove 0.872 hectares of native vegetation
  • Change aviation obstacle lighting requirements in response to increased turbine height

The Application to amend Planning Permit 2006/2022 (Ryan Corner) is to:

  • Correct addresses and title details of the land
  • Reduce the number of turbines from 68 to 56
  • Increase the maximum allowable height from 121.5 metres to 180 metres
  • Remove restriction on the maximum tower height and blade length, replacing with a restriction on the lowest swept height of:
    • metres above ground level for the 180 metre turbines
    • metres above ground level for the 160 metre turbines
  • Changes to noise conditions to require compliance with newer standards
  • Increase the distance from the nearest turbines within which a program of voluntary landscape mitigation works are available from 1.5 to 4 kilometres
  • Change shadow flicker requirements if consent is obtained from those affected
  • Remove 3.768 hectares of native vegetation
  • Change aviation obstacle lighting requirements in response to increased turbine height
  • General changes for consistency and update relevant agency names

The role of the panel was to review the application to amend the planning permit issued for the use and development of the Hawkesdale and Ryan Corner Wind Farms.

Panel members

The Minister appointed a Panel, which consisted of Brett Davis (Chair), Geoffrey Carruthers and Ian Harris.

Public Hearings

7-9 August 2017: public hearings took place at Port Fairy Community Services Centre, Port Fairy.

Panel Report

The Panel has submitted its report to the Minister for Planning.
