An advisory committee was appointed to review an Application for Review called in from VCAT against a refusal to grant an amendment to a planning permit to allow the transmission lines at Waverley Park to remain above ground.

Background

On 14 August 2002, the Minister for Planning approved Amendment C20 to the Monash Planning Scheme and issued Planning Permit No. STA/2001/000714 for the subdivision and development of Waverley Park.

Condition 50 of Planning Permit No. STA/2001/000714 required that:

The existing powerline easement through the land must be removed and the high voltage electricity transmission lines must be placed underground in a location and via a route which is to the satisfaction of SP/ Powernet or the relevant electricity authority.

On 8 June 2011, Mirvac (the proponent) lodged an application to amend the requirement to underground the transmission lines, as required in condition 50, and to amend the subdivision masterplan to show the transmission lines remaining overhead.

On 28 April 2014 the Minister for Planning issued a Refusal to Grant an Amendment to a Permit, with reasons for the refusal.

On 14 May 2014, Mirvac lodged an application for review of the decision at VCAT.

The Minister for Planning called in the VCAT proceeding on 14 August 2014 and established the advisory committee to review the permit requirements.

Report

The Advisory Committee submitted its report in February 2015.

Outcome

The  Advisory Committee report was published on 17 December 2015.

The Panel concluded that Condition 50 of the permit be amended to allow for the replacement of the existing transmission towers and lines with an above ground pole option.

In December 2015, the Minister wrote to those who had made submissions to advise that further engagement with the community would occur prior to making the recommendation to the Governor in Council. This would enable a better understanding of the community's views on the form of the proposed Community Benefits Package.

Futureye was appointed to facilitate this engagement with the community. In September 2016, Futureye provided the Minister for Planning with its Waverley Park Transmission Lines Consultation Report (PDF, 2.3 MB).

A recommendation will be made to the Governor in Council by the Minister for Planning in due course.
