Proposal

The Amendment proposes to: -Amend the Planning Scheme Maps to include the Portland Harbour area partly as a Public Park and Recreation Zone and partly as a Public Use Zone. The Amendment also adjusts the Special Use 4 Zone to accurately indicate the Port of Portland land ownership. The Current Planning Scheme Maps do not indicate zoning for parts of the Portland Harbour area that accurately align with the Municipal boundary. The Harbour Area is proposed to be zoned consistent with the underlying public use and port zonings based on ownership and existing use. -Amend the Planning Scheme Maps to include five parcels of land adjacent to the Portland Airport as a Rural Zone which is consistent with the underlying zoning. The land included is privately owned and does not form part of the Council Airport land. - Amend the Planning Scheme Maps to include land generally bounded by Hurd Street Tyres Street the Safeway Car Park and Henty Street Portland as a Business 1 Zone which is consistent with the existing land use patterns and would allow expansion of commercial and car parking uses and developments in this location. - Amend the Planning Scheme Maps to include land generally bounded by Henty Highway Cope Street Hanlon Parade Lowe Street and The Dutton Way Portland as a Residential 1 Zone which is consistent with the existing land use patterns and would allow expansion of residential uses and developments in this location. - Amend the Planning Scheme Maps to include land generally bounded by Henty Highway Princes Highway The Dutton Way and north of the Maretimo Estate Portland in part as a Residential 1 Zone and in part as a Rural Living Zone which is consistent with the existing land use patterns and would allow expansion of residential uses and developments in this location. - Amend the Planning Scheme Maps to delete the Development Plan Overlay controls which are an unnecessary duplication of controls contained elsewhere in the Planning Scheme. - Include a revision of the Schedules to the Rural Living Zone to provide for a minimum allotment size of 2 Ha. The current minimum of 4 Ha is limiting development of the zone and the provision of adequate services and infrastructure. - Include the Portland Foreshore Master Plan and its subsequent re-evaluation as incorporated reference documents within the Schedule to the Planning Scheme at Clause 36.02. The plan was incorporated in the former Portland Planning Scheme and has been through extensive exhibition and consultation processes. - Include a revision of the Schedules to the Heritage Overlay to correct a number of errors and omissions contained in the adopted Planning Scheme. - Delete the Development Plan Overlay control contained at Clause 43.04 together with the 6 Schedules associated with that clause contained in the Planning Scheme. The Development Plan Overlay controls are an unnecessary duplication of controls contained elsewhere in the Planning Scheme. - Include the Portland Town Centre Study and Car Parking Precinct Plans as incorporated reference documents within the Schedule to the Planning Scheme at Clause 52.06-2. The Amendment also provides a basis for the provision of car parking for new development in the Portland Central Business Area that recognises existing car parking provision within private and public land. - Include a revision of the Schedule to Clause 52.17 to the Planning Scheme to clarify that a permit is not required for specified Native Vegetation removal. - Include a revision of the Schedule to Clause 81 of the Planning Scheme to include the Portland Airport Obstacle Limitation Plan as an incorporated document within the Planning Scheme. The Planning Scheme maps include an Overlay area adjacent to the Airport which controls glazing and noise issues associated with houses near the Airport. The Obstacle Limitation Plan limits the height of structures and plantations on land adjacent to the Airport and to ensure that new development does not compromise aircraft safety during approaches and departures - Update the Table of Contents to the Planning Scheme. - Include a revision of the List of Amendments to the Planning Scheme to include Amendment C5.
